Is it illegal or unethical for a bar, to refuse to pay for water customers?

I am a bartender in a small bar in Denver, CO, and we have free poker even though the owner makes that customers can not play when they buy something. Well, the weekend he saw a customer to the table with a Water, and I told him she had already ordered two, and he said he did not care if they are 12, not to serve them water. He reasons, they then have a drink of water the rest of the night, and he has to pay for their profits at the end of the game, it must be money away from them. I personally am having a difficult time denying people water, which were paid for drinks, so it's not like they are soliciting. I was told that this is illegal but I can not find anything on them.
